Hauling Contract

Payment Terms: Owner will pay total sum of below in U.S. Dollars, with deposit of one-half (50%) due upon signing and submitting this Agreement to reserve your stall on the trailer. The balance must be paid upon delivery in CASH Only. Deposit can be made by Square payment to wildhorsetransport357@gmail.com. Deposit is a non-refundable reservation fee unless Transporter cancels service. Pickup will not be scheduled until deposit is received. All payments are declared. We DO NOT accept Money Orders, Cashier’s Checks nor personal checks of any kind. The balance of total payment in U.S. Dollars is due in full at time of delivery. This balance will be accepted as CASH only. The balance must be paid upon delivery PRIOR to Transporter offloading any horse(s). Owner will reimburse Transporter in cash for any and all Veterinary services, medications or other medical supplies in the event of an emergency or as the Transporter deems necessary for the well- being of the above listed horse(s). Transporter shall be entitled to a lien against the aforementioned horse(s) for the value of services rendered; and, shall be entitled to enforce said lien in accordance with appropriate State laws. *

Horse Owner understands and acknowledges: insurance is not provided to the Horse Owner by the Transporter. If the Horse Owner elects not to secure insurance, then s/he agrees that s/he assumes all risks, expenses or liabilities associated with the transport. 2. In the event the horse(s) require the services of a veterinarian, Transporter will immediately attempt to notify the Horse Owner. In the event the Horse Owner cannot be reached, the Transporter is hereby authorized, as agent for the Horse Owner, to call the first available licensed Veterinarian of his/her choice. 3. All fees charged by said Veterinarian shall be the sole and exclusive responsibility of the Horse Owner, with no liability whatsoever to Transporter for such fees. Horse Owner agrees to reimburse Transporter for any veterinary services, drugs and other medical supplies in the event of an emergency or as the Transporter deems necessary for the well-being of the aforementioned horse(s). These fees are to be paid in full before the horse(s) are unloaded *

Other Charges: The rate quoted is for delivery and care of your horse(s). Surcharges may apply for any of the following: A. Waiting time at a barn for the pick-up or delivery person will be charged at a rate of $50 per hour after the first 30 minutes waiting. A change of pick-up or delivery location from original quote may be subject to additional charges. B. A “Hard Loader Fee” of $50 per hour will be applied after the first 30 minutes of attempted loading or unloading. We do not desire to load or ship unruly horses. No tranquilizers will be administered by our drivers for the purpose of loading or hauling and we do not load nor transport any horse that has been tranquilized. If a horse becomes a danger to itself, the drivers or other horses, it will be safely offloaded at an equestrian facility and the owner will be notified to make other arrangements with no refund. C. Any damage to the trailer or equipment caused by your horse. We will (fairly) estimate the cost of repairing the damage at delivery and this amount must be paid PRIOR to unloading your horse(s). If the actual cost is more or less than that estimate, we will supply you with a written estimate or bill from the repair facility and make an adjustment with you. D. Failing to give Transporter adequate and specific directions to pick-up and delivery locations will be charged at $50.00/hr and $2.00/mile. Even though Transporter utilizes the best GPS technology, GPS is not always accurate to locations off main roads. It is sometimes necessary to give Transporter exact mileage from point to point along with landmarks. Notify Transporter if any address does not come up on GPS. HORSE OWNER Will send a fitted halter and lead rope with their horse or a halter and lead rope will be provided and Horse Owner will be charged for purchase. $25.00 for Halter and Lead Rope or $10.00 for Lead Rope. *

Release of Liability: Horse Owner hereby voluntarily releases and forever discharges the Transporter and its agents from any and all liabilities, claims, demands, actions, or rights of action, which are related to, rise out of, or are in any way connected with the transport of the aforementioned horse(s). Horse Owner further agrees, promises and covenants not to sue, assert or otherwise maintain or assert any claims against the Transporter or its agents or employees, for any injury, death, disease, or damage to the aforementioned horse(s) arising from or in connection with the transport, care or feeding of said horse(s) or from any claims asserted by other third parties. Entire Agreement: Owner understands this is the entire agreement between Horse Owner and Transporter, its agents or employees, and it supersedes and cannot be modified or changed in any way the representations or statements of any agent or employee of the Transporter or Horse Owner. Changes must be agreed to in writing by both parties (Emails are legally binding Agreement. Email changes to jonesg1@earthlink.net - MY SIGNATURE AS OWNER BELOW INDICATES THAT I HAVE READ THIS ENTIRE DOCUMENT, UNDERSTAND IT COMPLETELY, AND AGREE TO BE BOUND BY ITS TERMS IN ITS ENTIRETY. Returning this Agreement by email is considered under U.S. Code as an electronic signature, “…as an electronic sound, symbol or process attached to or logically associated with a contract or other record and executed and adopted by a person with the intent to sign the record”. *
